OT4U forms "partnerships" or alliances with some of these vendors from time to time in order to facilitate the provision of these products and services to you. However, you acknowledge and agree that at no time is OT4U making any representation or warranty regarding any third party's products or services, nor will OT4U be liable to you or any third party for any claims arising from or in connection with such third party products and services. OnTime4U at its sole discretion may choose to change the terms, conditions and operation of this site at anytime. By using this service you waive any rights or claims you may have against OnTime4U.

In the event that you are dissatisfied with our service, OnTime4U will undertake its best efforts to resolve the matter to your satisfaction. If you still remain dissatisfied after OnTime4U's attempts to resolve the matter, the following terms and conditions apply. Please note all refund requests must be made within sixty (60) days of issuance of services. OnTime4U cannot issue refunds if such request is made over sixty (60) days following the dispatch of the services by OnTime4U.

Transmission of email is at your own risk. OnTime4U cannot accept responsibility for your transmission of confidential information or any obligation with respect to that information.

You agree that you are responsible for the spelling and other information forwarded to OnTime4U and that information is exactly as you desire for OnTime4U to perform the Services requested. Submission of credit card information via our website, via facsimile, or otherwise authorizes OnTime4U to charge your credit card for the Services.

You agree that, if an agent (e.g., an relative, business associate, health care provider, etc.) purchased our Services on your behalf, you are nonetheless bound as a principal by all terms and conditions herein.

OnTime4U, in its sole discretion, reserves the right to refuse to provide Services to you. You agree that OnTime4U shall not be liable to you for loss or damages that may result from our refusal to provide Services.

In the event that any of the provisions of this Agreement are held to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect.

This Agreement is entered into in the state of Oregon and shall be construed in accordance with the laws of Oregon, exclusive of its choice of law rules. You submit to the exclusive jurisdiction of the State and Federal Courts having jurisdiction in the County of Marion in the state of Oregon, and you waive any jurisdictional, venue, or inconvenient forum objections to such courts. In any action to enforce this Agreement, the prevailing party will be entitled to costs and attorney fees.

You agree that you are in compliance with all applicable laws and regulations pertaining to or governing your use of this Site, and you agree to indemnify and hold OnTime4U harmless from and against any and all claims, damages, losses or obligations suffered or incurred by you arising from your failure to comply.

No term or provisions hereof shall be deemed waived and no breach excused, unless such waiver or consent shall be in writing and signed by the party claimed to have waived or consented. Any consent by any party to, or waiver of a breach by the other, whether express or implied, shall not constitute consent to, waiver of, or excuse for any other different or subsequent breach.

You agree that this Agreement amounts to the complete and exclusive agreement between you and OnTime4U regarding our Services. This Agreement supersedes any prior agreements and understandings, whether oral or written and whether established by custom, practice, policy or precedent.
